Our shop is hosted on Etsy. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, or that you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction. We reserve the right to refuse Service to anyone for any reason at any time. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

All of our crochet products are handmade by hand, one at a time. As a result, slight variations in colour, shape, or size compared to product photos may occur. These variations are a natural part of the handmade process and are not considered defects.

We have made every effort to display our products as accurately as possible. We cannot guarantee that your device's display of any colour will be accurate. We reserve the right to limit the quantities of any products or services that we offer, and to discontinue any product at any time without notice.

Under the EU Consumer Rights Directive (2011/83/EU), consumers within the European Union have the right to withdraw from a distance purchase within 14 days of receiving the goods, without giving a reason. To exercise this right, please contact us at yahne@fableandfernstudio.com within 14 days of receiving your order. The cost of return shipping is borne by the buyer. Items must be returned in their original, unused condition.

All sales of digital products (such as illustration downloads) are final. In accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal does not apply to digital content where delivery has begun with your prior express consent and acknowledgement that you thereby lose your right of withdrawal. By completing the purchase of a digital product, you confirm this consent.

We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email address provided at the time the order was made. You agree to provide current, complete and accurate purchase information for all purchases made at our store.

Certain content, products and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of those sites, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites. Complaints or concerns regarding third-party products should be directed to the third party.

Your submission of personal information through the store is handled in accordance with the General Data Protection Regulation (GDPR, Regulation 2016/679). Only products explicitly marked as "CE certified — child-safe for ages 3 and up" on their product page have been assessed in accordance with the EU Toy Safety Directive (2009/48/EC) and are considered suitable for children aged 3 and above. This marking is displayed on the individual product page for qualifying items. These products may include small parts such as safety eyes and carry the appropriate age warning where required.

All other products sold by Fable & Fern Studio — including crochet items not bearing this marking — are intended as decorative objects or collectibles for persons aged 14 and over. These products are not designed, tested, or marketed as toys, and are not suitable for children under the age of 14. They may contain small parts or other features that present a hazard to young children.

By purchasing a product that is not marked as CE certified on its product page, you confirm that you understand it is not a toy and that you accept full responsibility for ensuring it is kept away from children under 14. Fable & Fern Studio accepts no liability for any injury, damage, or incident arising from use of such a product by a child under 14, or from any misuse or use outside of the intended purpose of any product.

If you are unsure whether a specific product is CE certified or is suitable for a particular recipient, please contact us before purchasing.

We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free. The Service and all products delivered to you are provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, either express or implied.

To the fullest extent permitted by applicable law, Fable & Fern Studio, our affiliates, agents, contractors, or suppliers shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Service or any products procured using the Service. This includes, without limitation, any injury, damage, or loss arising from the use of a product not marked as CE certified on its product page by a child under 14, or any use of a product outside its intended purpose. Where liability cannot be excluded, our total liability shall not exceed the amount paid for the product in question.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law. In particular, and in accordance with EU Directive 85/374/EEC on product liability (as updated by Directive 2024/2853/EU, applicable from December 2026), we do not exclude liability for damage caused by defective products where such liability is mandated by law.

As a consumer in the EU, you also benefit from the mandatory statutory guarantee of conformity under Directive 1999/44/EC and its successor provisions under Directive 2019/771/EU, which provides a minimum two-year legal guarantee on physical goods. Nothing in these Terms affects your statutory rights.

You agree to indemnify, defend and hold harmless Fable & Fern Studio and our affiliates, partners, officers, agents, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service without affecting the validity and enforceability of any other remaining provisions.

You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
